This file includes correspondence between Edwin C. Brown, a lawyer retained by by the local branch of the National Association For Colored People and the Parent & Teachers Association of Douglass Elementary School of Leesburg, Virginia, to O.L. Emerick, Superintendent of Loudoun County Public Schools. On 9 May 1951, Brown requests information about the unsanitary toilets at Douglass Elementary School which he hopes can be addressed without resorting to court action. Emerick replies five days later that he expects the issue to be remedied by the time students return in the fall but that there are also new schools to build in Waterford, Ashburn, and Mountain Gap. Emerick threatens that, should the issue go to court, the project will be delayed as funds will be needed to defend the district in court. In conclusion, he suggests that Brown come talk to the school board before filing. On 18 May, Emerick forwards Brown's letter to the other school board members.

Dear Sir:
Please be advised that my office has been consulted by the local branch of the National Association For Colored People and the Parent & Teachers Association of Dougless Elementary School of Leesburg, Virginia.
I have been requested to ascertain from your office and the school board what, if anything, can be done to remedy the sanitation of the toilets at the Dougless Elementary School.
I am happy in the hope that this situation can be remedied without Court action.
Please let me hear from you at your earliest convenience as I have been requested to institute suit in the Federal Court for the adjuication of the same.

Dear Mr. Brown:
I have your letter of the 9th of May in reference to the sanitation of the toilets at the Douglass Elementary School.
Our school board has appointed a committee with instructions to make definite recommendations in reference to this improvement. I think that you can be assured that the condition will be remedied before schools open next fall.
The problem is a rather difficult one for the reason that our program of school construction provides for a new, school building on a new site to accommodate these children and those at the Waterford, Ashburn and Mt. Gap Schools.
Of course, if you institute suit in Federal Court the school board will be inclined to use funds that might be made available to make the improvements to defend itself in the courts, and while it might not change the outcome, it would of course cause a delay.
This matter will be presented to our school board at its next meeting on June 12.
I would suggest before you file suit that you come up here and talk to the school board about this matter, as it is their purpose and intention to improve the situation at this school.
